Digital Millennium Copyright Act (DMCA) Notice and Takedown Policy.
Signal Business LLC ("gotosignal.com") respects the intellectual property rights of others and expects users of our platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond to clear notices of alleged copyright infringement involving content hosted on or accessible through our platform, including content posted by our users on their business profiles.
Reporting Alleged Copyright Infringement
If you believe that material available on or through gotosignal.com infringes your copyright, you (or your agent) may send a written notice (a "DMCA Notice") to our Designated Agent. To be effective under 17 U.S.C. 512(c)(3), your DMCA Notice must include substantially the following:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it, such as the profile URL or page;
- Your contact information, including your name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Designated Copyright Agent
Please send DMCA Notices to our Designated Agent:
- Agent: Copyright Agent, Signal Business LLC
- Email: support@gotosignal.com (subject line: "DMCA Notice")
- Website: https://gotosignal.com
Note: The Designated Agent details above must be registered with the U.S. Copyright Office Directory of Designated Agents and kept current. We may update this contact information; please verify the current agent before sending a notice.
Our Response
Upon receipt of a valid DMCA Notice, we will act expeditiously to remove or disable access to the allegedly infringing material and will take reasonable steps to notify the user who posted it. We may forward the DMCA Notice (including your contact information) to that user.
Counter-Notification
If you are a user whose material has been removed or disabled and you believe the removal was the result of mistake or misidentification, you may submit a written counter-notification to our Designated Agent. To be effective under 17 U.S.C. 512(g), your counter-notification must include substantially the following:
- Your physical or electronic signature;
- Identification of the material that has been removed or disabled and the location at which it appeared before it was removed or disabled;
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA Notice or that person's agent.
If we receive a valid counter-notification, we may restore the removed material in 10 to 14 business days unless our Designated Agent first receives notice that the complaining party has filed an action seeking a court order to restrain the allegedly infringing activity.
Repeat Infringer Policy
In appropriate circumstances and at our discretion, we will disable and/or terminate the accounts of users who are determined to be repeat infringers. We may also limit access to our platform or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is repeat infringement.
Misrepresentations
Please be aware that under 17 U.S.C. 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. If you are unsure whether material infringes your rights, you should consult an attorney before submitting a notice or counter-notification.
